A report submitted to the high court on Thursday by Advocate on Record Sneha Kalita revealed that “the total number of cases pending from December 2018 was 4,110; and as of October 2020 there were 4,859 ”.

“Even after the dismissal of 2,775 cases after 04.12.2018, the number of cases against Members of Parliament increased from 4,122 to 4,984. This indicates an increase in the number of pre-crime criminals taking seats in Parliament and in State Legislatures, ”the report said, adding that“ urgent and urgent action is needed to end pending criminal cases. ”.

Hansaria said “the status report filed by the High Courts also shows that Special Courts are formed in some provinces and, in some jurisdictions, the administrative courts conduct cases in accordance with the guidelines passed from time to time”.

“These Courts of Courts are conducting cases against Members of Parliament and Members of Parliament and the release of other officers assigned to them. In most districts, the same educated judge is the Special Court under various laws such as the SC / ST Act, POCSO Act, etc., ”the report said. He urged the SC to order that “Courts facing Members of Parliament / Members of Parliament will only hear these cases” and that “other cases will be considered only after such proceedings” to avoid delays.

“The trial will take place on a daily basis …” and “the allocation of the required work will be done by the Supreme Court and / or the Chief Justice of all districts in two weeks”, he said.

The bench was taken from Advocate Ashwini Kumar Upadhyay demanding the expedition of cases involving Members of Parliament and Members of Parliament and the banning of those convicted of anti-election offenses. Hearing this, the SC said that in November 2017, it ordered the establishment of Special Courts in each region to hear pending criminal cases against lawyers. Therefore, 12 such courts were established throughout the country.
